L'utilisation de bodycams est de plus en plus répandue dans les zones de police locale. Est-ce une bonne chose? Les avis sont partagés. Il est ici question d'une importante donnée de sécurité qui constitue donc une matière transversale impliquant divers niveaux de pouvoir. 1) Êtes-vous favorable à l'utilisation de bodycams? 2) Tous les membres de la police fédérale disposent-ils d'une bodycam? Combien en sont équipés? Quel pourcentage cela représente-t-il? Disposez-vous de statistiques relatives: a) au nombre de corps ou de zones de police qui recourent à ces caméras? Quel pourcentage représentent-ils? b) au nombre total de policiers concernés? Quel pourcentage représentent-ils? Est-il possible de ventiler entre les trois Régions les statistiques évoquées ci-dessus? Je souhaiterais également obtenir ces chiffres pour les cinq dernières années civiles. 4) A-t-on déjà réalisé des analyses ou des études au sujet des expériences ou du ressenti des policiers concernés? Het gaat hierbij over een belangrijk veiligheidsgegeven en is bijgevolg een transversale aangelegenheid die betrekking heeft op de diverse overheidsniveaus. 1) Is de geachte minister voorstander van het gebruik van bodycams? 2) Beschikken alle leden van de federale politie over een bodycam? Of hoeveel? Welk percentage? 3) Heeft ze cijfers over: a) hoeveel korpsen of politiezones er gebruik van maken? Welk percentage? b) hoeveel politiemensen het in het totaal gaat? Welk percentage? Is het mogelijk voor de twee hoger aangehaalde cijfers een onderverdeling te maken tussen de drie Gewesten? Graag had ik ook deze cijfers gehad gedurende de laatste vijf kalenderjaren. 4) Zijn er al analyses of studies geweest over wat de ervaringen of gevoelens zijn bij de betrokken politieagenten? 1) & 5) Les bodycams (caméras
corporelles) sont incontestablement un instrument utile pour le
travail de la police, qui offrent de nombreux avantages tant pour le
citoyen que pour nos policiers. Nous ne pouvons jamais tolérer
la violence à l’encontre des policiers. Toutefois, les
interventions illégitimes de la police ou les interventions
légitimes pour lesquelles des plaintes ont été
déposées profitent également de la
contextualisation fournie par les images et des preuves qu’elles
peuvent apporter sur les délits observés et les
interventions effectuées. Plusieurs études académiques
et projets pilotes sur le terrain ont démontré que
l’utilisation de bodycams a un effet de désescalade
en cas d’incident. De nombreuses zones ont déjà
utilisé la bodycam dans le cadre d’une phase
pilote. Les expériences sont positives et le soutien du
personnel a progressivement augmenté au fur et à mesure
qu’il se rendait compte de l’utilité de
l’objectivation d’une intervention. J’ai estimé
qu’en dépit du fait que la bodycam pouvait déjà
être utilisée dans le cadre légal existant,
certains aspects devaient être clarifiés. Des
clarifications dans la loi étaient nécessaires à
cette fin. En outre, il est important que chaque citoyen puisse
compter sur un service et un traitement uniforme. Pour ce faire, le
ministre de la Justice et moi-même avons établi des
directives opérationnelles claires pour les zones de police
locale et la police fédérale. La bodycam n’est
toutefois pas un outil obligatoire et ne fait pas partie de
l’équipement individuel. En ne rendant pas son
utilisation obligatoire, je respecte l’autonomie des zones de
police et des autorités locales.

Les bodycams
sont donc des dispositifs à utilisation
collective et les unités déterminent le ratio
d’attribution des bodycams
pour leurs services sur le terrain. Il est dès
lors logique que les besoins varient
fortement d’une unité à l’autre.
Pour la police fédérale, 2 255 bodycams
ont actuellement été distribuées selon la
répartition suivante:
– Direction générale de la
police administrative (DGA): 1 881;
– Corps d’intervention (CIK): 360;
– Direction générale de la
gestion des ressources et de l’information (DGR): 14 (à
des fins de formation).
3) Tout d’abord, je voudrais attirer
l’attention de l’honorable membre sur le fait que la loi
du 7 décembre 1998 organisant un service de police
structuré à deux niveaux prévoit en son
article 3 que «les services de police sont organisés
et structurés à deux niveaux: le niveau fédéral
et le niveau local, lesquels assurent ensemble la fonction de police
intégrée. Ces niveaux sont autonomes et dépendent
d’autorités distinctes».
La banque de données «Management
Information System» (MIS) est une banque de données
de la police dans laquelle sont enregistrés les résultats
des enquêtes morphologiques annuelles de toutes les zones de la
police locale, notamment les moyens logistiques dont disposent les
zones de police.
Les enquêtes annuelles de morphologie dont
proviennent ces données ont comme date de référence:
31 décembre 2022.
Les données reprises ci-dessous concernent les
années complètes de 2018 à 2022. L’enquête
morphologique auprès des zones de police concernant l’année
2023 est en cours et donnera des résultats dans le courant de
l’année.
Le premier tableau en annexe indique le nombre de
zones de police disposant de bodycams, regroupées par
Région. Ce tableau comprend également le pourcentage du
nombre de zones de police possédant une bodycam par
rapport au nombre total de zones de police dans la Région
respective. Dans le tableau, les cellules contenant les valeurs des
zones de police qui ont cessé d’exister à la
suite d’une fusion sont indiquées en gris.

En ce qui concerne la question 3) b) sur
«le nombre de policiers concernés au total», le
MIS ne contient aucune information. Une fois encore, comme il s’agit
d’un équipement collectif, ce nombre variera chaque
année suivant les fonctions pour lesquelles le responsable de
l’unité déploie les bodycams,
en fonction du ratio entre les effectifs et de la disponibilité
des appareils.
4) Une étude sur les bodycams datant de
2021 a été réalisée par la Katholieke
Universiteit Leuven (KUL) et l’Université de Liège
(ULiège):
«Des recherches antérieures ont
montré que les policiers étaient généralement
positifs à l’égard de la bodycam.
Les policiers utilisant les bodycams
sont conscients que les enregistrements par caméra
corporelle peuvent les protéger car les citoyens sont moins
susceptibles de déposer des plaintes infondées
lorsqu’ils savent que l’incident a été
enregistré.»
«En général, des recherches
antérieures montrent que les citoyens sont positifs quant à
l’utilisation des bodycams. Ils estiment que
l’utilisation de la bodycam conduira à une force
de police plus responsable, à une plus grande confiance des
citoyens dans la police et à une légitimité plus

1) & 5) Bodycams zijn
onomstotelijk een nuttig instrument voor het politioneel werk. Zowel
voor de burger als voor onze politieambtenaren biedt de bodycam
veel troeven. Zo kunnen we bijvoorbeeld geweld
tegen politieambtenaren nooit tolereren maar ook onrechtmatige
optredens van politie of rechtmatige optredens waarover klachten
werden geformuleerd hebben ook baat bij de contextualisering die de
beelden geven en bij het bewijsmateriaal dat deze kunnen aanleveren
over de vastgestelde misdrijven en de gedane interventies.
Verschillende academische studies en proefprojecten op het terrein
hebben aangetoond dat het gebruik van bodycams
een de-escalerend effect heeft bij een incident.
Tal van zones gebruikten de bodycam
reeds in een pilootfase. De ervaringen zijn
positief en het draagvlak bij het personeel steeg gaandeweg doordat
zij ook het nut inzagen van de objectivering van een interventie. Ik
was van mening dat ondanks het feit dat men de bodycam
reeds kon gebruiken onder het bestaande wettelijke
kader, er toch enkele aspecten waren die opgehelderd dienden te
worden. Hiertoe waren verduidelijkingen in de wet nodig. Daarnaast is
het belangrijk dat iedere burger kan rekenen op een éénvormige
dienstverlening en bejegening. Hiertoe heb ik, samen met de minister
van Justitie duidelijke operationele richtlijnen voor lokale
politiezones en de federale politie gegeven. De bodycam
is echter geen verplicht instrument en maakt geen
deel uit van de individuele uitrusting. Door het gebruik niet te
verplichten respecteer ik de autonomie van de politiezones en de
lokale overheden.
2) Zoals reeds gesteld in het antwoord op
vraag 1) is de bodycam

Bodycams zijn dus toestellen voor collectief gebruik en de
eenheden bepalen de ratio van toekenning van bodycams voor hun
diensten op het terrein. Het is dan ook logisch dat de noden per
eenheid sterk kunnen verschillen.
Voor de federale politie zijn momenteel 2 225 bodycams
als volgt verdeeld:
– Algemene directie bestuurlijke politie (DGA): 1 881;
– Interventiekorps (CIK): 360;
– Algemene directie van het middelenbeheer en de informatie
(DGR): 14 (voor opleidingsdoeleinden).
3) In de eerste plaats wil ik het geachte lid er attent op maken
dat het artikel 3 van de wet van 7 december 1998 tot
organisatie van een geïntegreerde politiedienst, gestructureerd
op twee niveaus voorziet dat «De politiediensten worden
georganiseerd en gestructureerd op twee niveau’s: het federale
niveau en het lokale niveau, die samen de geïntegreerde
politiezorg verzekeren. Deze niveaus zijn autonoom en hangen van
verschillende overheden af».
De gegevensbank «Management
Information System» (MIS) is een
politiedatabank waarin data geregistreerd worden op basis van de
jaarlijkse morfologische bevragingen van alle zones van de lokale
politie, waaronder de logistieke middelen waarover de politiezones
beschikken.
De jaarlijkse morfologische vragenlijsten waaruit
deze data voortkomen hebben als uiterste referentiedatum: 31 december
2022.
De onderstaande gegevens betreffen dus de volledige
jaren 2018 tot en met 2022. De morfologische bevraging bij de
politiezones over het jaar 2023 is momenteel bezig en zal resultaten
opleveren later dit jaar.
De eerste tabel in bijlage bevat het aantal
politiezones dat beschikt over bodycams, gegroepeerd per
Gewest. Deze tabel omvat ook het percentage van aantal politiezones
dat een bodycam bezit ten opzichte van het totaal aantal
politiezones in het respectief gewest. In de tabel worden de cellen
met de waarden van politiezones die ophielden te bestaan naar
aanleiding van een fusie in het grijs aangegeven.

Met betrekking tot de vraag 3) b) over
«hoeveel politiemensen het in het totaal gaat» bevat de
MIS geen informatie. Opnieuw, aangezien het een collectieve
uitrusting is, zal dit aantal jaarlijks variëren afhankelijk van
voor welke functies de verantwoordelijke van de eenheid de bodycams
inzet, met welke ratio per personeelsaantallen en op basis van de
beschikbaarheid van de toestellen.
4) De Katholieke Universiteit Leuven (KUL) en de Université
de Liège (ULiège) hebben een studie uitgevoerd naar
bodycams in 2021:
«Uit eerder onderzoek bleek dat politieambtenaren over het
algemeen positief stonden tegenover de bodycam.
Politieambtenaren die bodycams gebruiken zijn zich ervan bewust dat
bodycams hen kunnen beschermen, omdat het minder
waarschijnlijk is dat burgers ongegronde klachten indienen als ze
weten dat het incident is opgenomen.»
«Over het algemeen, zo blijkt uit eerder
onderzoek, staan burgers positief tegenover het gebruik van de
bodycam. Zij geloven dat het gebruik van de bodycam zal
leiden tot een meer verantwoordelijke politie, tot meer vertrouwen
van de burger in de politie en tot een sterkere legitimiteit van de
politie.»
